These Terms of Service apply to Aty, operated by Artist Title Year, Inc. (“Aty,” “we,” “us,” or “our”).

These Terms govern your access to and use of Aty, including our website, artist and artwork pages, upload tools, claim forms, review systems, image matching systems, and any related services we provide (collectively, the “Services”).

By using Aty, you agree to these Terms. If you do not agree, you should not use the Services.

Aty is an index for artists and artworks that allows images of art to be traced back to the artist.

Aty may:

• —create artist and artwork records from publicly available information;
• —display public artist and artwork pages;
• —index artwork images and related metadata;
• —identify public appearances of artworks across the internet, which we call “Sightings”;
• —use computer vision, text matching, and human review to make attribution decisions;
• —allow artists to claim profiles and submit corrections;
• —link users to artist websites, galleries, social accounts, or other third-party destinations.

Aty is not currently a marketplace, payment processor, gallery, copyright enforcement agency, or legal authority on authorship or ownership.

Aty may create artist, artwork, and Sighting records before an artist has created an account or claimed a profile.

We do this to help artworks lead back to artists even when images have spread across the internet without clear attribution.

These records may be created from public web sources, including image-sharing platforms, social platforms, gallery websites, artist websites, user submissions, and manual research.

Artists may later claim a profile, submit corrections, add information, request that certain information be hidden, or ask us to review attribution decisions.

Aty may keep some internal records even when public visibility is changed, including for fraud prevention, copyright review, provenance, attribution accuracy, abuse monitoring, legal compliance, and platform integrity.

You must be at least 13 years old to use Aty. If you are under the age of majority where you live, you may only use Aty with the consent of a parent or legal guardian.

By using Aty, you represent that you are allowed to enter into these Terms and that your use of Aty complies with applicable law.

Some parts of Aty may require an account. You are responsible for keeping your account login information secure and for any activity under your account.

You agree to provide accurate information and to keep it up to date. We may suspend or remove access to an account if we believe it is inaccurate, fraudulent, impersonating another person, or being used in a way that violates these Terms.

Artists may submit a claim request for an artist profile.

Aty may verify a claim using methods such as:

• —a claim form;
• —review of the artist’s public website;
• —review of public social accounts;
• —sending a magic link or verification message to a social account, email address, or other contact method that appears to belong to the artist;
• —manual review by Aty.

Claiming a profile does not mean Aty has made a legal determination of copyright ownership, authorship, authenticity, provenance, or infringement. Verification only means that Aty believes the claimant has shown sufficient connection to the artist profile for platform purposes.

Aty may approve, reject, pause, revoke, or require additional verification for any claim. If there is a dispute, Aty may limit profile controls, hide certain information, merge or separate records, or take other steps we think are appropriate.

Early artist controls may include the ability to:

• —upload artworks;
• —claim profiles;
• —suggest metadata changes;
• —edit profile information, such as bio, social links, handles, and website links;
• —request that certain works or profile information be hidden or archived;
• —ask Aty to review an attribution, Sighting, or match.

Unless we provide otherwise, artists may not directly:

• —permanently delete raw platform records;
• —directly edit slugs;
• —directly rewire canonical artwork relationships;
• —delete Sightings;
• —delete raw objects, logs, embeddings, or review history.

Aty retains editorial and operational control over the structure of the index, including canonical pages, slugs, Sightings, attribution relationships, and internal records.

If you upload artwork, submit edits, submit links, suggest metadata, claim a profile, or otherwise provide content or information to Aty, you represent that you have the rights and authority needed to do so.

You may not upload or submit content that:

• —infringes someone else’s rights;
• —falsely claims authorship or ownership;
• —impersonates another person;
• —is unlawful, fraudulent, misleading, hateful, threatening, or abusive;
• —contains malicious code;
• —violates these Terms or any applicable policy.

Aty may review, accept, reject, edit, hide, archive, remove, merge, or decline to publish any submission.

You keep ownership of the content you upload or submit to Aty.

By uploading or submitting content to Aty, you give Aty a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, process, analyze, crop, transform for technical purposes, index, match, and use that content as needed to provide and improve the Services.

This includes using uploaded or submitted content for:

• —attribution;
• —identification;
• —visual similarity search;
• —image matching;
• —deduplication;
• —clustering;
• —canonical artwork pages;
• —public artist and artwork pages;
• —Sightings;
• —review workflows;
• —quality control;
• —abuse prevention;
• —copyright review;
• —platform security;
• —improving non-generative matching and attribution systems.

This license does not allow Aty to use your uploaded artwork to train generative AI models that create new artwork, imitate artistic styles, or produce derivative images.

Aty may index, organize, and display publicly available factual and descriptive information about artists and artworks.

This may include public images, captions, page URLs, artist names, aliases, handles, social links, artwork titles, medium, year, dimensions, source URLs, and relationships between pages or appearances across the web.

Aty may display limited images or thumbnails for purposes such as attribution, search, commentary, reference, identification, and linking back to artists or sources.

If you believe content on Aty infringes your copyright, please use our Copyright & DMCA Policy.

A “Sighting” is a public appearance or reference of an artwork elsewhere online.

Sightings may include information such as a source URL, image, caption, public username or profile name associated with the public page, date found, confidence score, or other context that helps users understand where an artwork appeared.

Sightings are used to help trace artworks back to artists. A Sighting does not mean the source page is authorized, endorsed, accurate, or affiliated with the artist or with Aty.

Aty may keep limited reference records of disputed, copied, unauthorized, or infringing works when doing so helps identify the original artist, prevent fraud, document provenance, support copyright review, or route users toward the original artist or artwork.

Aty uses automated systems, public information, and human review to make attribution decisions. These systems may be wrong.

An attribution, match, confidence score, Sighting, canonical page, artist claim, or verification badge does not constitute a legal determination of copyright ownership, authorship, authenticity, provenance, infringement, or permission.

You should independently verify information before relying on it for legal, commercial, curatorial, or collecting decisions.

Aty uses computer vision and automated systems to help reconnect artworks to artists.

These systems may include perceptual hashing, object detection, visual embeddings, text matching, and LLM-assisted extraction from public text.

Aty uses these systems for attribution, search, matching, deduplication, surfacing Sightings, ranking candidates for human review, suspected infringement detection, quality control, and abuse monitoring.

Aty does not use artwork, captions, embeddings, or artist information to train or fine-tune generative AI models that create new artwork, imitate artistic styles, or produce derivative works.

Aty may link to third-party websites, galleries, artist stores, social accounts, or other destinations.

Aty is not responsible for third-party websites, products, services, transactions, availability, pricing, shipping, refunds, or representations.

Unless we clearly say otherwise, purchases, commissions, inquiries, and transactions happen outside Aty and are governed by the third party’s own terms and policies.

Aty is focused on human-created artwork. We do not allow AI-generated artwork to be submitted as original human-created artwork.

You may not use Aty to upload, submit, promote, or distribute content that:

• —is unlawful;
• —infringes copyright, trademark, privacy, publicity, or other rights;
• —impersonates another person or artist;
• —falsely claims authorship or ownership;
• —is hateful, harassing, threatening, abusive, or discriminatory;
• —promotes violence or illegal activity;
• —contains sexual exploitation or abuse;
• —contains malicious code or attempts to interfere with the Services;
• —is spam or deceptive;
• —violates any Aty policy.

Aty may allow artwork containing nudity, including nude paintings or other non-exploitative artistic works, when we determine it is appropriate for an art index. We may restrict, hide, label, or remove content at our discretion.

Aty does not allow users to upload infringing content as their own work.

Because Aty is an attribution index, we may maintain limited reference records about disputed, copied, or unauthorized works when necessary to identify the original artist, prevent confusion, route searches toward the original artist, support copyright review, or maintain platform integrity.

Where appropriate, Aty may label, suppress, de-index, remove, or redirect pages involving suspected infringement.

If you believe content on Aty infringes your copyright, please follow our Copyright & DMCA Policy.

Aty owns the Services, including the website, software, design, databases, data structures, review workflows, matching systems, metadata schemas, taxonomies, and other platform elements, except for content owned by users, artists, licensors, or third parties.

You may not copy, scrape, reproduce, reverse engineer, or commercially exploit the Services except as allowed by these Terms or with our written permission.

You may not:

• —use Aty for unlawful purposes;
• —interfere with or disrupt the Services;
• —bypass access controls or security features;
• —scrape, crawl, or harvest Aty data without permission;
• —use Aty data to build a competing index or model;
• —use Aty data for generative AI training;
• —use Aty to profile or re-identify public users beyond the attribution use case;
• —use Aty data for advertising targeting;
• —submit false claims, false takedown notices, or false ownership information;
• —abuse claim, correction, or reporting tools.

Aty is an early product and will change over time. We may add, remove, suspend, or change features, pages, controls, workflows, or policies.

We may update these Terms from time to time. If we make material changes, we will try to provide reasonable notice. Your continued use of Aty after changes take effect means you accept the updated Terms.

We may suspend or terminate access to Aty if we believe you violated these Terms, created risk for Aty or others, submitted false information, infringed rights, abused the Services, or used the Services unlawfully.

You may stop using Aty at any time. Certain records may remain in our systems where needed for legal compliance, attribution integrity, security, fraud prevention, copyright review, backups, or legitimate business purposes.

Aty is provided “as is” and “as available.”

We do not guarantee that:

• —attribution information will be accurate;
• —every artwork will be identified;
• —every Sighting will be found;
• —every claim will be approved;
• —every correction will be accepted;
• —the Services will be uninterrupted or error-free;
• —third-party links will remain available;
• —Aty will detect or prevent infringement.

To the maximum extent permitted by law, Aty disclaims all warranties, express or implied.

To the maximum extent permitted by law, Aty will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, reputational harm, business interruption, or loss of goodwill.

To the maximum extent permitted by law, Aty’s total liability for any claim relating to the Services will not exceed the greater of: (a) the amount you paid Aty in the twelve months before the claim, or (b) $100.

You agree to indemnify and hold harmless Aty, its officers, directors, employees, contractors, and agents from claims, damages, liabilities, losses, and expenses arising from your use of Aty, your submissions, your violation of these Terms, or your violation of someone else’s rights.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules.

Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration, except that either party may bring a claim in small claims court if eligible or seek injunctive relief for unauthorized use of intellectual property or the Services.

You and Aty agree to bring claims only on an individual basis, and not as part of a class action, collective action, or representative proceeding.

Art spreads across the internet quickly. Names often get lost.

Aty creates an index so images of art can lead back to artists. Some profiles are created from public information before the artist directly participates.

The claim process allows artists to verify their connection to a profile, correct information, add works, and help improve attribution accuracy.

A profile may be claimed by:

• —the artist;
• —a person legally authorized to act for the artist;
• —an estate or rights holder;
• —a gallery, studio, manager, or representative with appropriate authority.

Aty may require additional verification for representatives, estates, galleries, or disputed claims.

To claim a profile, you may need to submit a claim form with information such as:

• —your name;
• —your email address;
• —the artist profile you are claiming;
• —links to official websites or social accounts;
• —other information that helps us verify the claim.

Aty may verify claims by:

• —reviewing the artist’s public website;
• —reviewing public social accounts;
• —sending a magic link or verification message to a social account associated with the artist;
• —sending a magic link to an email address listed on the artist’s website;
• —manual review by Aty.

A claimed artist may be able to:

• —upload artwork;
• —edit artist profile information;
• —add or update social links and website links;
• —suggest artwork metadata changes;
• —request that certain works be hidden or archived;
• —request review of incorrect attributions;
• —help confirm or reject matches;
• —receive information about Sightings, if available.

Specific controls may change as Aty develops.

Claiming a profile does not automatically allow a claimant to:

• —permanently delete all platform records;
• —directly edit slugs;
• —directly change canonical artwork relationships;
• —delete Sightings;
• —delete raw objects, review history, embeddings, logs, or internal records;
• —override copyright disputes;
• —make legal determinations through Aty.

Aty retains editorial and operational control over the index.

If more than one person claims the same profile or artwork, Aty may:

• —pause the claim;
• —request more information;
• —limit profile controls;
• —hide disputed information;
• —split or merge profiles;
• —add notes or labels;
• —reject or revoke a claim;
• —require legal documentation before making changes.

Aty is not a court and does not resolve legal ownership disputes. We may require parties to resolve disputes outside Aty before we make certain changes.

If you believe Aty has incorrectly attributed an artwork, you can request review.

Aty may evaluate:

• —uploaded portfolio images;
• —public source links;
• —artist names and aliases;
• —captions and handles;
• —visual similarity scores;
• —human review;
• —other evidence provided by artists or users.

Aty may correct, remove, suppress, label, or leave unchanged an attribution based on our review.

Artists may request that certain works, images, profile details, or pages be hidden or archived.

Aty will review these requests. We may keep limited internal records where needed for attribution integrity, copyright review, fraud prevention, provenance, security, legal compliance, or platform operations.

Claiming or uploading work to Aty does not give Aty permission to use your artwork to train generative AI models that create new artwork, imitate your style, or produce derivative images.

Aty uses computer vision for attribution, matching, deduplication, Sightings, review workflows, and platform safety.
